Notice
to passengers according to article
6 of European Regulation (EC) No.2027/97,
as modified and integrated by European
Regulation (EC) No.889/2002
According
to European Regulation (EC) no.
2027/97 – as modified and integrated
by European Regulation (EC) no 889/2002
(after the "Regulation") - the liability
of a Community air carrier (after
the "carrier") for damages sustained
in the event of
- death
- wounding
- any other bodily injury by
a passenger
occurred on board an aircraft or
in the course of any operation of
embarking and disembarking, shall
not be subject to any monetary limit.
For any damages up to the sum of
the equivalent in Euro of 100,000
SDRs, the carrier shall not exclude
or limit its liability by proving
that it and its agents have taken
all necessary and possible measures
to avoid the damage.
In case of damages exceeding the
sum of the equivalent in Euro of
100,000 SDRs, the carrier, viceversa, shall
exclude or limit its liability by
giving such a proof. The carrier
may be exonerated from its liability
if it proves that the damage was
caused or also partly determined
by the passenger with negligence
or with the intention to cause such
damage.
The carrier shall make such advance
payments to meet immediate economic
needs - on a basis proportional
to the hardship suffered - to the
natural persons entitled to compensation,
no later than fifteen days after
their individuation, and, in case
of death, no lower than the equivalent
sum in Euro of 16,000 SDRs per passenger.
